Terms of Service for FactsOnly

1. Acceptance of Terms

By using FactsOnly — sending it a reel, post, or claim — you agree to these Terms of Service and our Privacy Policy. The first time you message the bot, it sends a one-time notice pointing you here; continued use constitutes acceptance. If you don't agree, don't use the service.

2. Description of Service

FactsOnly is an automated fact-checking service, currently available on Instagram with more platforms planned. It:

• Performs metadata-first analysis for shared post links
• May request direct media upload when metadata is insufficient for confident verification
• Analyzes images and videos you send via DM
• Extracts factual claims using AI
• Verifies claims against reliable sources
• Provides verdicts (✅ Accurate / ⚠️ Mixed or False) with a per-claim breakdown and sources, and marks individual claims as "not confirmed" when reliable sources are insufficient
• Supports follow-up questions — reply to a verdict to ask for more detail
• Lets you flag a verdict you believe is wrong — reply "report wrong verdict" and we log it for review
• Stores structured claim records (normalized text, verdict, sources) anonymously for deduplication and reuse — raw media is never stored permanently, and verdicts carry no user identifier

3. User Obligations

You Must

• Be at least 13 years old
• Only send content you have the right to share
• Use the service for legitimate fact-checking purposes
• Respect the 20 fact-checks per day limit

You Must NOT

• Send spam, abuse, harassment, or illegal content
• Attempt to reverse-engineer or exploit the bot
• Use the service to harass others
• Circumvent rate limits
• Send sexually explicit or violent content

4. Disclaimers

No Warranty

FactsOnly is provided "AS IS" without warranties of any kind. We don't guarantee:

• Accuracy of fact-check results
• Availability or uptime
• Error-free operation
• Fitness for any particular purpose

Not Professional Advice

Results are:

• NOT medical advice
• NOT legal advice
• NOT financial advice
• NOT professional consultation

Always verify critical information with qualified professionals.

AI Limitations

• The bot uses AI models which can make mistakes
• Fact-checking is based on available sources at the time of analysis
• Absence of evidence is not evidence of absence
• New information may emerge after fact-checking

5. Fair Use & Copyright

Your Content

• You grant us a temporary, non-exclusive license to process content you send
• License ends when analysis completes
• We don't claim ownership of your content
• We don't republish or redistribute your content

Structured Intelligence

• You acknowledge that structured claim records (normalized text, verdict, confidence, sources) may be stored persistently
• This persistent storage is used for deduplication, consistency, and reuse
• Raw uploaded media is never stored permanently — it is deleted right after analysis completes

Our Analysis

• The service is intended for transformative analysis (extracting factual claims, not reproducing creative work)
• We aim to use only the minimum content necessary for analysis
• Fair use or similar exceptions can vary by jurisdiction and use case

Third-Party Content

• Don't send content that violates others' copyright
• You're responsible for having rights to content you send
• We're not liable for copyright issues with user-submitted content

6. Rate Limits

• Free Tier: 20 fact-checks per 24 hours per account
• A daily usage limit may also apply to keep the free service sustainable, so heavy use may be paused before the count above
• Limits reset daily
• Designed to prevent abuse and manage costs
• Limits may change with notice

7. Data Processing

Key Points:

• Ephemeral processing (media deleted right after analysis)
• No long-term storage of your raw media
• Structured claim intelligence is retained anonymously in Supabase
• Third-party AI services (Google Gemini) used for analysis
• You can erase your data anytime — send "delete my data" in the DM, email us, or remove the app from your Instagram settings (which triggers automatic deletion)

8. Service Modifications

We reserve the right to:

• Modify or discontinue the service at any time
• Change rate limits or features
• Update these terms with notice
• Block users who violate terms

Changes take effect when posted. Continued use = acceptance.

9. Termination

We may suspend or terminate your access if you:

• Violate these terms
• Abuse the service
• Engage in illegal activity
• Attempt to exploit or harm the service

You may stop using the service at any time by blocking or unfollowing the bot on your platform.

10. Limitation of Liability

To the maximum extent permitted by law:

• Decisions made based on bot results
• Third-party service outages (Instagram, Google)
• Data loss or corruption
• Indirect, consequential, or punitive damages

Maximum Liability

Our total liability is limited to $0 (zero dollars) since this is a free service.

11. Indemnification

You agree to indemnify us against claims arising from:

• Your use of the service
• Content you submit
• Your violation of these terms
• Your violation of third-party rights

• We're not responsible for platform actions

Google Gemini AI

• Subject to Google Generative AI Terms
• We're not responsible for Google's AI results

Tavily Search API

• Used for per-claim web search to find authoritative sources
• Subject to Tavily Privacy Policy

Google Search (Grounding Fallback)

• Subject to Google Terms of Service

Supabase

• Data may be stored in Supabase-managed infrastructure for persistent claim intelligence
• Operators are responsible for configuring Supabase security, retention, and jurisdictional controls

13. Intellectual Property

FactsOnly Service & Code

• The FactsOnly service and its source code are proprietary

Our Trademarks

• "FactsOnly" name and branding are our property
• Don't use them without permission

14. Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

15. Dispute Resolution

Informal Resolution

Contact us first by email (support@innovatechsolutions.tech) to resolve disputes informally.

Arbitration

If informal resolution fails, disputes may be resolved through binding arbitration where permitted by applicable law.

Class Action Waiver

Where permitted by law, disputes must be brought on an individual basis and not as class actions.

16. Severability

If any provision is found invalid, the rest remains in effect.

17. No Agency

Using this service doesn't create an employment, partnership, or agency relationship.

18. Entire Agreement

These terms constitute the entire agreement between you and FactsOnly.
